In 1990, the Supreme Court ruled that burning the American Flag was an example of constitutionally protected free speech.

Solution

When America adopts a pure democracy and its citizens govern the nation, place the issue on the ballot and let the people decide if they wish the symbol of their country to be defaced as a means of "freedom of speech".
